I am on L1 status now and came to US in Dec 2009 and working with L1 sponsored company but on Perdiem basis , not on regular US salary basis. I want to switch from L1 to H1 visa without resigning from L1 sponsored company, since I need to pay 4000$, if I resign. So, can I leave without telling them and join H1b employer. Does L1 sponsor company make a legal case for not resigning. I have valid H1 till 2011. Please post any ideas.

---- What do you mean by you have to pay $4000 and to whom. It si purely illegal and you do not have pay anyone even a dime irrespective of all agreements and contracts, unless you are compelled by some means and you agree for that payment
---- If you want to resign and join another company it is perfectly legal and no company nor any person can stop you from that
---- Be honest. Let the employer know that you are leaving them and joining another cvompany on H1. There is no harm in that nad that also keeps up your relations with the company. After all you have a valid H1 petition (I-797)in hand and there is nothing illegal about it.
