  • H1B Expiry soon...Extension documents...

    Hello,

My H1B petition(first 3yrs) will expire on 28 Sept 2010 and i have not utilized my H1B so far as i am in India. I am travelling to USA on 1st Sept and my consultant had promised me with the openings they have i will get onto a project max my Sept 10th. My Question:

    1. While applying for H1B extension is 1 pay stub & other required documentation sufficient? I might ask my cons. to apply for premium processing extn.

    2. I can see many people are applying for extension 3-4 months advance, i have no choice to do that as i would have worked only 2-3 weeks in US before the expiry.

Has anyone heard of applying for extension just 2-3 weeks in advance and what are their experiences with it?

    Tnx,
    Sreenivas

You just need the pay slips only for period that you were in U.S on H1B status. The extension should be applied before the current I-94 that you receive at the POE expires. Like you have mentioned, it is advisable to file the extension in premium since you will have very less time.
