  • H-4 EAD application - Expedite request

    Hi All,

I'm currently working in Canada and my husband is in the USA (employed). My husband has an I-140 approved. I have a valid H-4 visa. I would like to apply for H-4 EAD to be able to move to the US and work from the US. We have been living away for more than 8 months and we got married last year.

I completed my master in the US (2015-2017). Started working in the US until 2020 (July). My H-1B application was never picked in the lottery in all the three attempts.
My employer moved me to Canada and I could continue working from Canada.

I would like to file for an expedite H-4 EAD application. My employer is wiling to provide me supporting documents for the need to work from US and the impact on the company if I don't work from the US. My work comes under essential worker category.

Can you please suggest if I should go ahead with the expedite request and what other documents would help me in this case.

    Thank you.

    Hi,
First, for applying H4 EAD, you will need to be in the USA. You can not process H4 EAD while you are in abroad. And also, per my knowledge, you will need to file first H4 EAD application. Later you can request for expedited with the supporting documents.
    Thanks

      Thanks rkk09 for the response.

I'm planning to move to US in Aug and I will apply for the H-4 EAD application from the US.

Can I expedite the H-4 EAD application soon after applying or I should wait for couple of days/months?

Have you come across/heard about approvals with after requesting to expedite the application?

      Thank you!!

        Hi,
I recommend you to take action, once you receive receipt notice.
And regarding Approval, Beneficiaries are getting approval with valid reason along with good documentation.
        All the best.
        Thanks

In case, my expedite application get's rejected due to the fact that my h4 ead application is within the normal processing time, can I request for expedite processing again after 60-90 days of my filed application?
          Thanks.

            Hi,
Yes. You can do that. You will need to follow the same procedure.
            Thanks
