H4 Visa Travel

Hey Everyone,

Currently I am on H4 visa in India with one month of validity left. My son is a us citizen and stays with me, now i want to travel to US on H4.

Do you think it will be an issue because only 1 month of visa left or I can enter in US even with few days of visa validity left. (My spouse plan to file extension as soon as I arrive in US).

Pls share your thoughts..

A visa is merely for entry purposes. It is your spouse's H1 expiry date that determines your duration of stay in the US.

@scientist2016 - yeah spouse visa is also valid for same time and employer filed for extension (still pending with uscis). So with this, do you see any issue at port of entry.

I recommend obtaining H4 Ext visa then travel. Typically, If you have a valid visa, with that, you can travel during approval period. But, at the time of CBP security check, they may raise the question about lesser duration approval and ext details too. To avoid such kind of scenario, better you obtain H4 extension visa then plan accordingly.
