Applying green card with two options

  • Applying green card with two options

    I am thinking to apply for green card either of these two options,Please validate and let me know which would be less panic.

    At present I am on H1B visa from 2008 and still I have 3 more years.
    My sister is a U.S citizen now.

    Here my question is Can I apply green card through my employer or let my sister apply the green card for me?
    I am not so hurry to get the greencard. Here my understanding of pros and cons about the two options.

    With Employer :
    Pros:
    I may get this process done in next 4 to 5 years.I have 8+ years Experience in software field, I guess I eligible for EB2.
    I can extened the H1B two more years (have 3 additionalyy 2 more years)
    Cons:
    I don’t have all the pay stubs and I have to stick with this same employer for next 5 years .This is where I am getting more pain.

    If my sister applys:
    Pros:
    No need to worry about pay stubs and No need to worry about employer ,I am like free bird.
    Cons:
    I may need to leave this country after 3 years (after 2013 since my 6 years H1 quota get over).
    Entire green card process may take 10 years.

    Pleas suggest me more prons and cons about my approaches and also let me know which one cost less (like lawyer fees and government fee)

    ---- If you have been employed full time and working for an employer since 2008 why is it that you do not have some pay stubs. It matters a lot for your own career. At the next H1 renewal you will be asked for the paystubs. For the GC they may not insist on psystubs but evidence that you are being paid regularly by the employer should be there

    ---- The process may take 10 years or even longer for a family based GC. The hassles that you undergo are same or similar to an employer based GC

    Pleas suggest me more prons and cons about my approaches and also let me know which one cost less (like lawyer fees and government fee)

    ---- It sure does appear that family based GC is less tedious and costs less, but an employment based GC is paid for by the employer, excepting some incidental costs to be incurred by you (for example taking your photographs)
    Even for a family based GC you will be going through an attorney to see that all conditions for the GC application process are met. In fact the fees may be more. You have to enquire with different lawyers ansd weigh the options. In an employment based GC the onus lies on the employer to ensure that you are paid regularly and they have filed their taxes on a regular basis. Also they should be able to provide you with employment in the future once your GC has been through

    All in all employment based GC would be my option and of course you have own reasons for a GC based on your reasoning

      F4 category is currently in 2001. It will take another 20 years for FB to be current.
