L1 to H1 process.....Urgent!

Hi,

Currently I am working on L1 and my Indian company is asking to come back. So, I am planning to transfer my L1 to H1B.

Questions:

1) How much time will it take for L1 to H1 transfer process?
2) Chances of successfully transfering L1 to H1B
3) required documents for L1 to H1 process
4) during this process can I travel to India or stay in US?
5) what if I travel to India, do I need to go for H1B Stamping?
6) Any additional info on this would be appreciated.

7 days for LCA + 2-3 months for regular processing/15 days for premium processing
2) Chances of successfully transfering L1 to H1B
Depends on various factors. You must maintain L1 status until the date H1 petition is received by USCIS. You must not have spent more than 6 years in L1+H1 status in the US.
3) required documents for L1 to H1 process
Your employer files the petition. Their lawyers will advise you. Read Visas section of this website.
4) during this process can I travel to India or stay in US?
Not recommended. If you travel, you must wait for approval and return with an H1 visa.
5) what if I travel to India, do I need to go for H1B Stamping?
Yes.
6) Any additional info on this would be appreciated.
