  • H1B transfer without entering US incase of layoff

    Hi,

I am in Canada and work for an US based every employer. My employer had filed for my H1B this year and got selected in the lottery. My petition did get approved and also I am done with stamping as well. I was about to travel in Oct.
My employer is undergoing acquisition and I have been told that my team is amongst the one who will be cut or laid off. So in this case what are the chances of H1B transfer? If I have an employer to sponsor new H1B transfer petition, should I go for it. Can the transfer be done as my I-797 is approved and visa is stamped while I am in Canada

    Hi,
If you need to transfer your H1B to any other Employer, Yes you can do even when you are abroad.. File the H1B transfer petition get the approved then travel with new Approval notice. Since you already got stamping, you don't need to again go for stamping too.
Can the transfer be done as my I-797 is approved and visa is stamped while I am in Canada?
Answer: Yes. You can do transfer with the help of previously approved petition. But, Please make sure, petition must be filed again with all supporting documents.
    Thanks
