  • H-1B unused till now

    Hi all,
I have a H-1b visa valid from Oct,2008 - Sep, 2011 sponsored by Company X. Unfortunately I could not travel to the US till now.
1)Is there a way to check if my employer has revoked my petition ?
2)Can i travel to the US now with this visa now even if my H-1b was revoked and get a job with any other company ?
3)if yes what are the chances of extension?

    Thanks in advance.

---- It is not possible unless you have spoken with the employer

==== You can certainly travel to the US on the existing vis, provided you still haave a job with the company. If you want to seek a job with another company, you cannot enter the US unyil you transfer the visa. Of course you can do that by coming to the US, joining the current employer and then applying fo the transfer. But make sure that you have a job with the employer before you embark on your journey

3)if yes what are the chances of extension?

---- You can apply for a H1 transfer once in the US and receive a new I797 wiht a valid I-94 to start work with the new employer

---- You may also transfer your H1 while you are out of the US and get the same I-797 and come to US on the olld company's visa and at the POE show your new I-797 to get a new I-94

Yes, a new company can petition for you any time.
This is my opinion and not legal advice.
