  • Reg: H1B work and transfer

    Hi

I have recently got my work permit approved for 3 years and am planning to go for stamping in a weeks time.
But before that i have some questions related to it.

    1) My employer has given me a Xerox copy of I-29 document which is validated and signed, that this is exact replica of original. Do i need to have the original copy also.
    2) What will i lose if i dont have an original copy of I-29 doc. Will it create any problems in taking transfer
    3) My petition says that if in case i make a shift to another employer then a fresh copy of petition needs to be filed? Does that mean a new H1B is to be filed and i cant take transfer on my original petition?
4)My present company in India is also planning to send me on L1. is it possible that i go on L1 and after 6 months i go for my H1B stamping from my US employee. Since my petition is approved?

    Any pointers would greatly help...

    Thanks
    Gurvinder

---- If you have the original I-129 it is better as the VO will be convinced of the petition and that your employer is not hiding anything from you

    2) What will i lose if i dont have an original copy of I-29 doc. Will it create any problems in taking transfer

    ---- Nothing

    3) My petition says that if in case i make a shift to another employer then a fresh copy of petition needs to be filed? Does that mean a new H1B is to be filed and i cant take transfer on my original petition?

---- When you apply for a H1 transfer, you submit a copy of the original petition as proof of your current employment (together with othere documents). The transfer process is almost like a new H1, excepting that you will be getting the remaining time on your H1 from the new employer

4)My present company in India is also planning to send me on L1. is it possible that i go on L1 and after 6 months i go for my H1B stamping from my US employee. Since my petition is approved?

---- Yes, you can come on L1 to the US and then do a COS from L1 to H1 whenever you wish by submitting all the required documents and evidence of employment

      1) No
      2) NA. See above
      3) Transfer is nothing but a new H1 but cap-exempt
      4) Yes. But Visa officer might choose to cancel one of H1/L1.
