Spouse is on H4 in USA and need help in H1 Trasnfer

Hi All,

Thank you for taking the time in reading my question.
My wife is with me in the USA on H4. Her employer is in India and they filed H1B and it's now approved. They want her to come back to India and get her visa stamped and travel to the USA. They won't be sharing the approved I-797 receipt and we don't know the receipt number too.
Is there a way we can get the I-797 copy and transfer the H1b to a different company?

What are the best options? (Consulates are closed in many locations in India and its hard to get a slot for Visa stamping)

Please help us with the best possible options so that my wife can start working here in the USA.

Hi,
In order to transfer H1B to another Employer, you will need previously approved H1B details. At least you will need receipt number. If you dont have, you can call to USCIS and get the help. Normally, under FOIA you can get the details from them.
But, I am surprise, why they dont want to share. I can say, It is your rights to have approval notice. When you go for visa stamping, You will need full petition package.

Answer: Not like that. People are started booking appointments. A friend of mine has booked appointment for Oct 2021 today. If Interview dates are stopping you, Please try once and get the date soon. And other option is, If you can get the approval notice then you can file H1B transfer with change of status while you are in the USA.
