Possibility of Stay after H1 Maxout

Hi,

My H1 visa will be max out on Jan so as per the rule I need to leave the country before the Jan. But my wife is caring so we would like to deliver the baby here for which due date is Feb 1st week. Is there a way if we could stay after visa expiry for 3 to 3 and half month? Please suggest what are the possible ways.

Hi,
Once your I-94 got expired you can not stay back to the country. Either you will need to extend your current status or file change of status petition. Without anything, staying in the USA will make some problem to you.
You can change your status to B or F1. But you will need to have accurate intention to change your status to concern visa status.
