    Hi,

    I am in a unique situation and looking for advice.

    I am having a change of status from L1B to H1B effective 01-OCT-2021. My L1B was under location A (my current location)and H1B was filed under location B. I am planning to request for an amendment from location B to location A for my H1B so that I can continue in location A. However my amendment filing process can start only on OCT 01 as my employer needs 2 weeks to complete the entire process so it would be filed to USCIS only by OCT-15. For the span OCT-01 to OCT-15 since I will be legally on H1B under location B, I am planning to physically live in that location and come back to location A once the amendment is filed.
    I wanted to know if I can stay in a hotel during this 15 day period and can that be my official residential address for those days? Or should I only take a rental home on a lease. I know this address will go into my salary slip for that period which may get submitted to USCIS during my future extension. I want to make sure that I do not violate anything.

    Answer: Yes. If you stay in the hotel for some days, you can provide the hotel address. But, If this is temporary, you can wait until you get new home then provide. On another hand, if you stay in the hotel for long time, no issues of providing hotel address as living place. Please make note, whenever you have any address change, you will need to file AR 11 form through USCIS portal.

      Your situation is indeed unique. To put it bluntly, it seems to me that you are overdoing it. Don't get your head into such things. I think that if you have been staying in a hotel for quite a long time, I can assure you that there will be no problem with giving your hotel address as your place of residence. And I think that even if you are only staying for a couple of days, you still won't violate anything and can give the hotel address as temporary accommodation. There's nothing wrong with temporarily staying in nearby hotels. I happened to do that at one of the Australian hotels, too. I was here. However, since it is a rather luxurious hotel, I would call staying there more of a vacation than a forced measure.

        As long as you can receive mail and other official documents at the hotel's address, it should be fine. Just make sure to inform your employer about this arrangement, so they can include the hotel address on your salary slip if necessary. Also, keep in mind that your future extension might require you to provide documentation, so it's a good idea to keep records of your hotel stay. By the way, have you considered staying at Si Como No? It's a resort in Manuel Antonio, Costa Rica. They offer comfortable accommodations and a beautiful tropical setting.

            Your plan sounds solid, and staying in a hotel during that gap seems like a practical solution.

            I had a similar situation a while back when I was shifting cities. I stayed at this charming hotel, kind of tucked away but right in the heart of the city, accor sydney cbd —the vibe was just perfect. It gave me the flexibility I needed while I sorted out my new place.

            Regarding your concern about the address on your salary slip, it's great that you're being diligent about it. I'd suggest maybe keeping some documentation handy just in case, like a hotel confirmation or something similar, to cover your bases."
