  • H1B extension processing time...

    Hi All,

    I have heard in some forums that H1B extension processing time(in regular mode)any where between 1 month to 6 months depending on the case. My H1B Visa expires on 28-Sept-2010. Currently my wife is in India whose H4 will also expire on 28-Sept-2010 and i don't want to wait for her to travel only after 6 months in worst case. My employer has applied for H1B extension and they have advised my wife not to gor H4 stamping until the extension is approved. I have also heard the extension processing time really depends on the case type and if the case is not complicated it should happen fast, not sure how much true it is. Any experiences to share?

    I have a question now,

    - Can we convert the extension to premium mode by paying 1000$ after waiting for 1 month if the extension is not approved yet by then?

    ---- Yes you can convert your H1 processing to premium processing and you will receive a decision within 2 weeks. But remember that your employer has to pay the amount of $1000 for the premium processing

      Have the same problem... expired on 9/28 and applied for extension on 6/28 but the extension is not approved yet. Still hanging out there... life on the edge... i got no driving license... cant buy alcohol... they ask for id... keep wondering, what did i sign up for?

        I am also waiting on my H1 extension petition, which was filed way back in april. I-94 expired on 09/29. I do not know how many more days it will take for this petition. Is there any reason for this undue delay ?

          If it has already past 90 days, then you can ask your company attorney to take an infopass appointment with USCIS to dicuss the progress of your case.
