Hi All,
I have query regarding my next year H1B visa filing.
I am on L1B right now and moving back to India on 24th Oct 2021 as my 5 years of term is about to completed.
My employer will file H1B visa next year(in March 2022). I don't have my I140 process started yet.
Have following queries.
1. If I selected in 2022 lottery and my petition gets approves, will I get valid petition/stamp for next 3 year if I am going for visa interview after 31st October 2022(this is how I will stay 1 year in India).
_OR_
1. I will get only 1 year valid petition irrespective of when I am going for visa interview.
2. For example, if I only get 1 year petition and during that time If I don't have I140 process going on, do I need to go for new lottery in March 2023 _OR_ I can use this approved petition for further extension.
