  • Lost Indian Passoprt with H4 visa and i 94

    I lost my Indian passport with H4 Visa and i 94, i have gone through the consulate web site and they are asking the proof of residence unfortunately all bills are under my husband name and proof of H4 visa .. as i lost my passport i dont have anything now ....i have the photocopy of my passport (first two pager and last tow pages)

    i have all my documents like Degree certificates..

    can any one please suggest me what options do i have.

    waiting for yours reply... i am so tensed not sure what to do as i have tickets already booked for india after 25 days.

    ---- First file a police complaint and take that report to keep it with you and produce it whenever asked

    ---- Regarding bills, if all the bills are with your husban;s name, produce them with the proof showing that you are married to the person (like having amarrieage certificate, bank accounts etc.)

    ---- Complete the form for New Passport issue (in lieu of the lost Passport), take photographs of yours, the maount to be paid for Passport renewal and go to the Indian Consulate personnally (making sure that you have all the necessary documents)

    ---- Apply for the new Passport in person (if there are other questions by the Consulate be ready to answer those queries like additional documents and other proofs

    ---- Hope all the above will be good enough for you to get a new Passport

    ---- Do not worry about the H4 visa. When you go to your home country (be sure to produce the valid original H1 petition of your husband to get teh visa stamped

      Thanks a lot for yours quick response really appreciate that.. can you please suggest me what can be done for I 94.

      do i have to apply for replacement of i 94 through USCIS.
      If yes do you have idea how long it will take to get one.

      Me and my husband hve booked the ticket to india after 25 days.... so would that be possible to get all the docs before that, i understand you can not give me the exact ans ... but as you are senior so what you suggests.

      Should i go through some lawyer or i should file for Passport, Replacement of I 94 by myself.

      Last but not least sorry .... is there a way to get the VISA stamp in US.

        0000 If you are going to travel out of the US, then there is no need to apply for a I-84 replacement

        ---- No, unfortunately you cannot get a visa stamped while you are in the US

          But i was reading forums on this site and they are saying that I 94 is imp as we have to surrender it so that immigration can mark i am out from US.

          and it will save me from problems when i am coming back to US... else they will ask questions ... or will there be any Problems while coming back to US ......can you please suggest on this.

          Thanksssssssss again .... atleast some one is there to show some path...

            You will need to apply for the replacement I-94 and return it when you leave the country. Otherwise, your exit record will remain open and will cause issues when that I-94 expires.

              Thanks shervin ... i got the procedure to apply for replacement of I 94 believe that is I 102 form ... but do you have any idea how long USCIS will take to provide that .... or is there an option i can travel with the Reciept of replacement of I 102.

              Reason why i am asking is we have the tickets already booked for india and unfortunately this incident happen .....

              Appreciate all your help

                If you had to travel before you receive the replacemenet I-94 from USCIS, then upon returning back, your will need to surrender the replacement I-94 (You will get a new I-94 at the POE) with all the proof that you actually left the country. Check the below link

                  Thanks is small word for you guys .... one last question ( i believe) so once i will come back to US, the immigration officer at point of entry will not ask me about my old I 94 ( as not sure if he can figure out (some record on his PC) that i have not surrender the old I 94 when i was leaving the US)

                    They won't ask you that at the POE. It is your responsibility to return the I-94's when you exit the country to keep your entry/exit record clean. Expired open I-94's will most likely cause issues when you apply for extensions or when you go for visa interview the next time.

                    Carry the documents to prove that you have indeed applied for a replacement I-94 just in case.

                        Hello Senior members,

                        I spoke to Chicago consulate for my new passport but they are asking about VISA proof, which i dont have unfortunately (dont have the photo copy), are there any other options i can prove my VISA status ( H4).

                        Please let me know .. waiting for yours ans ..

                          The I-94 is proof of your status, not the visa. If you have a copy of the I-94, that would suffice. I have not read the entire thread below to see if you have a copy of it or not.
