Last Date for filing H1 Application

Hi,

I am new to H1 process. I was planning to approach my employer for H1 for FY 2010. Before I could do that I got to know that I wont be able to file for F1 after 30th September for the current year and will have to wait till April 2011. I do hear the opposite versions too.

Which one of them is correct?

The CAP is still open. You can file the H1B petition for Fiscal year 2011 until the CAP remains open (Even after September 30th).
