  • Job Switch immediately after 140 approval

Hello Readers and experts in the group,
Not sure this question has been asked earlier in the group, but I wanted to know some insights about job switch immediately after 140 approval. Below is my scenario :

My PERM got approved about a month ago and employer has filled I140 in regular processing. My H1B max out time till Jan End. I am getting offers from other employers. I want to know is there any risk in switching the job ? I would first get my I140 approved in premium then ask new employer to file for H1B transfer, I know I would loose PD which is of Jan 2021. But are there any restrictions apart from that ? I have not informed new employer about my visa status as of yet and do not want to give any false promises. New job is on similar lines of Job description in PERM application.

Any suggestion on this topic are highly appreciated.

    Hi Member,
Since your H1B max out is approaching near future, you will need first I-140 Approval to extend your H1B with any of the Employer. But if you move to another Employer upon getting I-140 Approval, the current Employer may withdraw your I-140. If the I-140 is withdrawn within 180 days from the approval then you will loose the benefit to extend your H1B with any of the Employer. You can hold the Priority date in this situation. But extending H1B will be complicated.
If you ask me, It is better to stay with current Employer for another 180 days from the date I-140 Approval then think about transferring H1B to another Employer.
    All the best.
    Thanks
