  • B1 to H1b under Cap Exempt

    I got my h1b approved in January 2014 with employer A, and i traveled to the USA in Feb 2014
    In 2015 i transferred my visa to employer B, later in 2017 I again got a job offer and transferred visa to company C, I started working for company C after receiving my visa transfer receipt, but while I was working with company C and my visa transfer processing was still with uscis, I left the country for some reason and the petition was withdrawn from USCIS by the company. and my employer B I -129 was only valid till 2017.
    My question is I still have close to 3 years on my h1b under Cap exempt, and i hold a B1 visa as well. so can I go to USA on b1 and find an employer who could transfer my h1b and could I start work without coming to my home country for stamping.
    any suggestion could help.
    Note: my last stamp h1b is expired in 2017.

    The employers you ran out on were required to tell state who would invalidate your existing visa. It's illegal to use your B1 visa as you propose. If you are truthful, they will certainly deny you entry. If you lie, you are committing immigration fraud and should be barred for a good long time.

    Your option is only to get a H-1B visa approved by an employer you actually intend to work for.
