H4 to H1 COS and transfer to new employer

  • H4 to H1 COS and transfer to new employer

    My wife entered USA on H1 and did job for few months after which she had to change status to H4. Can she now change her status back to H1 and also transfer H1 to new employer at the same time? OR does she need to change status to H1 through existing employer and then transfer H1. She doesn't have current paystubs and she has just got the offer from new employer no offer letter yet. Does the new employer need offer / client letter of some sort to apply for COS to H1 and H1 transfer?

    >>> That is not required.

    She doesn't have current paystubs
    >>> One cannot work on H4 and ofcourse she won't have pay slips. If she pay slips for the period when she was in H1B status, then she is fine.

    >>> Yes. USCIS will need to see the offer letter and the client letter (If it is a consulting company).
