H4 extention

Hello. I am in USA on H4 visa. My spouse changed his job and got a new i797 valid till Oct. 2024. My H4 visa is expiring in May 2022. If i file an i 539 application, it is taking almost an year to get the results. My query here is that, is it possible to get an i94 extended through flagpolling via USA and Canada land border crossing in Pembina, North Dakota?

Yes, you can leave and re-enter on your still-valid H4 visa and your spouse's new H1b petition approval, and you should be admitted until the end date of that new H1b petition approval (assuming your passport doesn't expire sooner).

But what's the problem with waiting a year for I-539?

Thanks for your response !!! No problem with waiting for I-539 for an year however getting I-94 extended immediately and that too without spending $370 for I-539, seems to be a good option to me.

Hey. Just for viewers information. I got an extended I-94 matching my spouse's I-797 by visiting to CBP office at Pembina - Emerson border.
