Fresh H1 B Petition Filling

Hi, I travelled along my family on H4 visa to US & meanwhile my H1B LOTTERY results turned out positive. I am currently working remotely on requirement basis for my Indian project from US. Also, my Indian organization is interested in filing H1B petition for my this year. Please advise if there any non-compliances involved while I stay on H4 in US & my company proceeds in fresh H1B PETITION application.
Also, am I required to be back in India during H1B Petition filing - if so, by how so soon ? Also, during my H4 stay in US, should I apply for leaves in my Indian organization ? Pls advise the best way to proceed.
