I recently received I-140 immigrant petition approval in march 2022 and I have applied for H4 EAD for my spouse. I have H1-B and all H4’s valid until June, 2023. These days H4 EAD processing time is ranging from 6 months to 1 year and with this scenario if I receive H4 EAD approval after like 8 months, I’ll have a validity of just 6 months on EAD left and I’ll need to file again immediately the moment I receive and file H1-B & H4 in Dec. 2022 i.e. 6 months before petition expiry to timely receive H4 approval and avoid any discontinuation on H4 EAD.
Query: Is there a way I can refile H1-B & H4 for an extension of 3 years since I now have I-140 approval? I recently also received H1-B and H4 approvals in Jan. & march 2022 respectively and these are valid until June 2023. With this I don’t have to go through renewal troubles again at the end of the year and avoid EAD- extension issues as I’m foreseeing. Looking for guidance on how to handle this best. Thank you
