  • H4 visa - what to do to.become independent

    Hi, is there anybody who knows what kind of visa I would be eligible of getting instead of the H4 (spouse of H1-B visa holder)?

    To make it short, my kids and I now are very dependent on my husband with our H4 visas. After 8 weeks, I still have not got a bank account and pay for a lot of things with my UK credit card. I cannot earn money, so I am supposed to be completely dependent on my husband, which I am finding very difficult.

    We're also starting to have some marital issues, but if we really split, I need to be with the kids and they seem to love this place. Now, I am fine doing any jobs - from admin, accounting, IT support and customer service through to translations and preschool teaching - I've done it all and have an IB, a degree in Business Admin & IT as well as a college qualification as a UK early years educator.

    Where do I start though. Do I need a lawyer to change my visa? Is it even possible to do? Or do I look for an employer who helps me with the process? I am new to all this, as I was used to work in the EU and applying for any work I fancied.

    There's no visa for "people who are here based on a family member who don't want to rely on that." If you qualify for some other visa, like an H1B you can certainly apply for that if you have a willing employer. This means you have to either find a job/employer that is cap exempt or participate in the lottery (unless you have a lottery selection from before).
