  • H1B Transfer - Unable to join

    Hi,
I am a H1B visa holder currently working with company A. My H1B transfer was approved in premium processing by employer B. The offer letter which I have signed with company B has the following clause - "If you rescind your acceptance of this offer of employment after the company has incurred costs for the filing of your H-1B transfer application, the company may recover such costs directly from you, to the extent permitted under law."

If I choose to continue working with my current employer A, is it legal for the company B to claim any any fees from me? If so, kindly let me know what all fee can be included and the approximate fee that companies usually claim in such scenario.

It's against US law to try to recoup H1B fees whether the employee works for them or not.

They'll have to deal with the fact that you screwed them by your unethical behavior.
