I am working with employer A on L1B that is going to expire in Dec'22.
I have been picked in H1B lottery from employer B and H1B petition is already filed for that and it is under progress. Now my current employer A wants me to start with L1B extension process early as per company policies so that we get L1b extension status before L1b expires.
Here, I have following questions
- will L1B extension have any impact on my H1B application through different employer?
- What will happen if my L1b extension approves after H1B, will L1b extension or L1b again override the H1b status? (considering L1B extension will be effective in Dec'22 i.e. after Oct 1when H1B will be effective)
- What will happen if my L1B extension approves before H1B then will my H1B COS petition rejected as L1B extension approved? (though H1B is already under progress and L1b extension still need to file and L1b extension approval/denial possibility before H1B seems unlikely)?
- Will my current employer get to know about my H1B application in case I get RFE or L1B extension rejected (most probably due to H1B already under progress) and they give reason of rejection to my company?
- Also, in case my another H1B lottery picked from my current employer in second lottery if happens, so will I be able to shift to my current employer as my H1B will already be approved through second employer?
