  • B1 to H1B is it possible

    Hi,

    I am in India and i have B1/B2 Visa on Jan 2009 onwards. My dream is to get a good job in US. even though i have visited couple of times in B1 Visa with clean records, but it was for training. I have 10 years of exp in Networking with ( CCNA and MCSE ) and with basic Bsc degree from Chennai. I heard that US has tighten H1B jobs and increased Visa fees and decreased jobs for foreigners. I am applying jobs through Myvisajobs and h1base everbody. The first answer i receive is " Sorry , we not in position to sponsor you for H1B". I know that i can't work in B1 Visa. what is next way to fulfill my dream, off course its everybody dream.

    My question is

    1) Can i visit US in B1 and find a sponsor and convert the status to B1 to H1b?
    2) can i apply for next year 2011 -2012 from India itself?

    ---- YES, you can speak to an employer and if they agree get teh H1B sponsorship. But understand that you will get an approved H1 petition without the I-94 adn in that case you have to leave the US, get a H1 visa stamped on your Passport and then enter US

    ---- Of course this is the saem as finding an employer while you are in India, get the H1B sponsorshipa dn then get a H1 visa and enter the US

    2) can i apply for next year 2011 -2012 from India itself?

    ---- You can apply at anytime. For your information the H1 quota is still open for the fiscal year 2011. The quota is not yet closed. It will be closed only when USCIS gives out a press release. So far USCIS has not that

    ---- If you try you may be successful in the next couple of months

      A COS from B1/B2 to H1B is never advisable. you will endup answering a lot of questions when you go for visa interview the next time. Using B1 visa to travel to U.S in search of jobs violates the purpose of the B1 visa.

      Like mentioned in the previous reply, look for jobs from your home country. If you find an employer who can sponsor you the H1B, then they can immediately file the petition, since the CAP is still open.
