  • H1B extension/transfer multiple filings....!

    Hi,

    I came to USA on my H1B through Company-A.

    My H1b expired by Sep-27-2010 and I-94 by Oct-7-2010.

    Before Sep-27-2010, two companies filed for my extention and transfer.

    Company-B under normal process.
    Company-C under premium process.

    Both B & C applied at the same time for A to B & A to C transfer.

    I got my receipt from Company-B and started working on their payroll.

    But till now none of the decission is received.

    Questions:
    =======
    1) Will my case be considered as H1B bridging?
    2) What if A to C (premium) application got rejected, will that effect decision on A to B?
    3) What are my chances on this?
    4) What if I want to file another application, do I need to file from B to D or A to D?
    5) Will it be more critical if I file another application?

    ---- It is possible that the transfer case is a bridging case

    2) What if A to C (premium) application got rejected, will that effect decision on A to B?

    ---- All applications are considered independently and one does not have bearing on another. Thus A - B is independent of A - C

    3) What are my chances on this?

    ----- Both can be approved if all the documents are in order adn if the USCIS is satisfied with the entire application

    4) What if I want to file another application, do I need to file from B to D or A to D?

    ---- Well, you can do so if you find another employer and teh application will be treated independently and separately

    5) Will it be more critical if I file another application?

    ---- There is no crticality as the criteria for consideration of each application are one and the same adn tehy are treated independently

      Multiple Approvals - Switch Employer after approval

      I am at same situation of mlpathir. Subramanya's answer got clarified me most of that. I have another question in addition to that.

      Applied Transfer : A->B and A -> C. Consider, both transfers are approved at same time. I am started working on Company B. After few months, Can i switch my employer to company C without doing any paper work as they have approval.

      Is it legal?
      Is there any time span to do that?

      I am kind of critical situation to decide employer. Please help.

        Possible as long as you have not travelled outside. No timeframe as long as the petition is valid and came with an attached I-94.
