  • H1B stamping : 220 g issue

    Hi All,

    I had my H1B stamped thru company A in India and then transferred my H1B successfully to company B in India itself . I then travelled to US thru company B , but didnt go for another stamping.

    I successfully entered US and worked there for 2 years , till I came back to India for vacation , where I went for stamping just to get the new employer name on visa. That is when I received 220 g slip asking me for further documentation.

    I called up my company B to provide me with further documentation , they have initiated suggested me to travel back on my existing H1B stamp ( which is still valid..its valid till 1 year).

    Would it be ok to travel on that visa stamp? please advise

    If you still have a valid H1B visa in the passport (assuming the passport is with you and the visa isn't cancelled), then you can travel. You don't need to get a new visa just to change the employer's name.

    If you no onger wish to continue with the stamping process, then withdraw the visa application, so that the 221g doesn't ultimately ends-up on a visa denial.

          sorry for the typo... my question is how can I withdraw or cancel that application so that it doesnt end up in my visa cancellation?

          btw I had applied at New delhi consulate...

            You just need to send a letter to the respective consulate stating that you want to withdraw the application. You will need to give all the details for them to identify your application. Talk to VFS helpdesk @ Delhi for more info.

                One more thing, I have the passport with me with the stamp but how do I find out if my VISA is cancelled or not.

                  Look at the page in the passport where you have the visa stamped. If it is cancelled, then it will have a cancellation stamp over it. If not, it is still valid.
