I recently moved my home to a different city. Now attorney says this new city is not within MSA and due to hybrid model the new home location needs to be put in LCA with amendment. Earlier my home address and work location are in different cities that are not part of same MSA either. At that time they did not ask for amendment but rather asked to post a notice in home for 10 days.
My old home was 18miles from work location whereas my new home is 51 (its 49 if a different route is taken).
I looked for answers on the internet and not getting clarity on the commuting distance part. Some say the 50miles is just some number DOL used and its really not a hard rule. Now attorneys are saying my employer has to file both h1b amendment and new i-140 as they are location dependent.
Are they looking to make money from employer here or is the commuting distance that hard rule ?
