    Hi,

I am currently in India and my company has applied for H1B. Current status in USCIS shows as "Request for Evidence". I have a valid H4 visa till sep next year and due to some personal issues I might need to travel to US by end of this year. I was expecting to get my H1B before that. Now that the status is RFE I am not very sure of that. Given the situation here are the question I have...

1)Even if I do not get the H1B by then, is it ok if I travel to US on H4.
    2) Will there be any future impact on getting H1B or green card at a later stage, if I stop the H1 B processing in between now?

    Please advise.
    Thanks in advance.

Why not? The person can travel on H4 and maintain H4 status as long as the spouse is in US on H1b status. To get back on H1b, you would have to file for an amendment or get a visa stamp.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
