  • How to explain extra deductions in paystubs

    Hi,

    My employer has been deducting $1000 every month from my payroll as adminstrative expenses. Now I am going to india for stamping my H1B and was wondering if there will be an issue with the Consulate when they review my paystubs.


    Would it help to be say that it was a loan that I am paying back to my employer?

    As long as your payslips and W2 matches with the approved LCA, you are good.

      Your employer is not allowed to take money from you for any immigration processing expenses or job consideration or sponsorship. What are the deductions for? You may have grounds for an unfair immigration-related employment complaint. Please see:

          the deductions are for the federal and social service tax that my employer has to pay. thanks for the links. I will definitely check them out. but since my GC processing is being done by him, i guess i am stuck with him for a long term.

            Thos have to be paid by the employer. Why are they being deducted from your end? Looks like you and your emplyer are both involved in something illegal with such a kind of set-up.

              Taxes that are deducted are labelled as such NOT as "administrative expenses".

                Hi OP,

                There are taxes which needs to be deducted from your paystub -like State tax , federal tax,social security tax and other Medical insurance premiums (which can total upto 1000$ /month - depending on Gross salary and withholdings declared).

                BUT as mentioned they should be labelled/heading separately for each deduction and not as a Collective deduction (under "Administrative Charges").
