H1B cap exempt eligibility

Hello everyone,

This question might have been asked before, but I couldn't find a relevant thread.

I was in H1B for 3 months in 2007 and returned to India. After I came back to US in L1 visa which is about to expire. Am I eligible to re-apply for H1B as cap exempt petition as I haven't used the complete 6 year period and still with the same employer who filed the H1B in 2007? Appreciated any responses.
