  • H1 extension after 6 years

    It has been about 5 and half months since my H1 extension application, but the status still says.
    "Initial Review
    On July 1, 2010, we received this I129 PETITION FOR A NONIMMIGRANT WORKER, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you........."

    This has me worried.
    My I-94 already expired on 9/28/10. My attorney says that the california service center is processing june 10 applications right now. ( when i go to https://egov.uscis.gov/cris/processTimesDisplayInit.do and click on 'service center processing dates' it does say June 10 for 'H-1B - Specialty occupation - Extension of stay in the U.S.' , however that was last updated on 10/14/10 and it also says 'Field Office Processing Dates for California Service Center as of: August 31, 2010' )
    So i am assuming that on 8/31/10 they were processing applications of 6/10/10 (processing time 2.6 months) i should have received some response by now!

    Any advise would be highly appreciated.

    Quit whining. Just wait, do you have any idea the volume of those petitions? The limit of visas avilable has varied over the last decade. They get approved initially for 3 years then renewed for 3 more then they were getting 1 year extensions then additional 3 years extensions. Compound them year after year and you're talking 3/4 to 1+ million extensions a year. Then, consider that they come in waves.

    Calm down.

      You can ask your company attorney to take an info pass appointment with USCIS to discuss the progress of your case (since its been more than 90 days the extension is filed).


      You can also speed up the process by going for premium processing which will get you a result within 15 days.

        Now thats just a stupid reply!
        Visas were getting processed in 2-3 monthsjust a few months ago. so i dont see why it should take double the time now all of a sudden.
        if they indeed take that long then they should stop displaying processomg tome as 2-3 months.
