    Hi, I got laid off by employer on December 9th on H1B & my 60 day grace period ends around Feb 8. I’m thinking to move to H4 and then get H4 EAD. What I’m confused about is : Should I file an H4 COS + H4 EAD from US? Or should I go to India and get my H4 by visiting the Indian consulate for interview and then after coming to US file for standalone EAD?

    I have done my F1 and H1 here and H1B will have around 1.7 yrs remaining once H4 gets filed. Also, my parents are waiting for their GC. Their status as of now is I130 approved and they have received their EADs & AP as of now. Can my F1 & H1B history and my parents having pending GC status increase my risk of H4 RFE or denial if I go to an Indian consulate interview?

    I’ve to take a decision very soon on how to proceed. Any advice/suggestions would really help me.
