Hi,

Employer 1 has filed H1 for me and it got RFE .

I have offer from employer 2.

Can I file second I-129 while first H1 case remains under RFE or under process?

completing RFE and then H1 transfer will take hec lot of time. I want some quicker solution to move to employer 2.

---- Yes you can file for a second transfer of your H1 even if your first H1 is under process for whatever reason. One does not affect the other and both the applications will be treated independently and you should receive an independent decision on each of them separately

---- You can asnwer the RFE and thd process of reviewing your application and the RFE response will take its own course of time

Hey, thanks so much for the reply.

I checked with the lawyer.. Now I am asking lawyer of company 1 to withdraw the case ..

and lawyer of company 2 will apply for new H1 petition.
