  • H1B without Pay stubs

    Hello.

I am on h1b visa. Unfortunately I am out of job from last four months so my paychecks have not been run. But my employer has promised that he will not revoke my visa till it expires (i.e, till 2012) and asked me to look for another employer meanwhile.

The problem is am still finding hard to find the job. I’m worried about my status without paycheck.

Can some one please tell me how long can I hold H1B without running paychecks.

Any help with be much appreciated.
    Thanks,
    Angadi

Even if you find a new employer at this stage, an H1B transfer with a new I-94 is not possible as you are out of status. You will need to provide the latest pay slips when you apply for a transfer. The possibilities are, your transfer might get approved as a consular process. In which case, you will need to go out fo the country and return back on H1B visa.
