I am an engineering manager with Indian origin (25+ reports with 2 managers). I moved to London, UK from San Bruno, CA in May 2022 for the purpose of transitioning back to the US under L1-A for green card in the EB-1C category. I technically have H1-B till mid 2025 in a paused state.
When chatting with my lawyers they recommended I come back on L1-A and not H1-B. So I plan to apply for L1-A in June and head back to the US when I get my visa approved.
Here is the question - Once I file I-140 and get it approved (premium processing is here!), can I do change of status to my existing H1-B? I am not sure if I want to stick with my company when I am back and look for other opportunities. Any thoughts?
