Currently I am working on L2 EAD. We are planning to change the status from L1/L2 to H1/H4. We have i140 Approved. We are thinking to apply H1/H4 with future dates (max 6 months advance). Can’t apply H4 EAD in bundle due to Employer restrictions.
Questions:
1. Can USCIS approves H4 EAD on the basis of H1/H4 approval but before H1/H4 status are activated?
2. What happens if USCIS start processing H4EAD but H1/H4 are not approved yet? Would they put the application on HOLD for 90 days?
3. If above options are not valid what is the best option to move from L2 to H4 with minimal job interuption?
