  • H1B Visa Stamping (Need advice...)

    Hello,

    I'm on H1B visa and I work for a client through a vendor, i.e., the flow would be My employer -> Vendor -> Client. Due to personal reason I had to visit India this month end, the problem is my visa got expired and I'm on extension period, so I had to get my visa stamped to return back to US.

    The question I have is, since I work for a client through a vendor, is there any problem for visa stamping? I heard about the "Employee and Employer relationship" rule, seems like a person (with H1b) should not work for a third party company (via Vendor)... The contract we have with the client would continue until my extension period expire. Could you please give me some guidance on this matter? Also it will be great if you could provide me the required documents (as per my situation) to carry for Visa stamping. I had planned to return on Jan mid.

    If you have the client letter, vendor letter, SOW between the vendor and the client and the SOW between your employer and the Vendor, then that would help a lot. Search for similar posts in immihelp and read the experience posted by others.
