  • H1B Stamping in Mexico - URGENT

    Hello Everyone,
    I am in my 4th year of H1B and my I797 is valid till 2013. My H1B visa got expired in 2009. I need to visit India and I have a couple of options - to go India/Mexico/Canada to get stamping. I know its a kind of tough now a days to get stamping without an issue so just wondering if this is a possible option:
    what if I - go to Mexico and then go to India and come back in 2 weeks to Mexico and return to US, utilizing the 30 day US border country rule. Of course, I will not apply for visa in Mexico/India.
    I am not sure if this is a good option or not but technically is this feasible? can anyone please share your advise? Thank you very much in advance!!

    Hi OP,

    I am not sure what you are implying or what you are trying to do????

    Base line is : as your visa is expired in 2009 - so where ever you go Mexico or India - you NEED TO GET H1 Visa STAMPED in your passport before you return/enter US.

    as per my understanding - you can go to Mexico , get your stamping done in Mexico , Then go to india and then come back directly to US (don;t know why you want to come backto Mexico again?)
    Only risk is if by any chance you don;t get your stamping done sucessfully in Mexico for any reason- then you cannot comeback to US - either you go to India or wait in Mexico for your visa to be approved/stamped (in that case it is adivsable to ger Mexican Visa)
    Search for Forums where people have shared their expriences for Visa Stamping in Mexico.
    OR
    Go to India directly and get your stamping done there and come back.

      If thos was indeed a possible option, none of the people will ever get the renewal stamping done again. Everyone will go to their home country through Canada or Mexico and re-enter through the same route provided the duration of stay outside U.S is less than 1 months.
