    Hello:

I am filling out DS-160 form for my wife who is currently in India and came across below question and wanted some help on this.

Select the location where you will be submitting this application?

    A. I would like to put Hyderabad, but after giving it as Hyderabad and later if I change my mind and get an appointment in any other consular district, is this permissible?
(I know this is OK with HDFC receipt, as in, I can pay the fee in Hyderabad and get an appointment in Kolkata but not sure about DS-160).

Also, do I have to fill out another DS-160 for my 3 year old son?

    TIA,
    -Sachin

---- Yes, as long as you maintain the same application form wiht the same details as originally filled out. The DS-60 form remains the same for all US Consulates

(I know this is OK with HDFC receipt, as in, I can pay the fee in Hyderabad and get an appointment in Kolkata but not sure about DS-160).

---- Yes, each applicant should have a DS-160 form completed with teir name and aldo the fees should be paid separately and have separate feS receeipt

      H4 - ds160 - vfs - hdfc

Subramanya & other senior members, you guys are just fabulous. I can see so many people being benefited with your helpful responses, I feel very luck to see this site.

Anyway, on the same subject (OP) I have a couple of more questions.

Can DS-160 be filled irrespective of whether or not I get the HDFC receipt number? Or is there any dependency?

In DS-160, there is a question "How long do you plan to stay in the USA?". My current situation: My existing petition will soon expire, by 2/28/2011. I have already applied for the extension of H-1B. My wife and son are in India. Based on the existing petition, I am going to ask them to appear for the visa interview. Although the visa that will be granted will only be for 2-3 months (until my current petition is valid - 2/28/2011), my wife once she joins me here in the USA she will be here for longer time. So, for the aforementioned question, should I still say "3 months" or something like "2 years"?

One last question: In immihelp from the below link, it appears that 'one must visit any of the participating HDFC banks that falls under the jurisdiction of the US embassy where one will be going for an interview., eg: If you are going for an interview in Mumbai, you can get the receipt from Pune or Mumbai or Ahmedabad but not Chennai or Bangalore'

Is this still good? If so, I can not get the receipt from Hyderabad and attend the interview in Kolkata, correct?

---Yes, the H4 visa will be granted for the period of validity of the H1 petition even if you write 2 years on the DS1-160 from. You may be wiser in letting your wife and kids go for the H4 visa once you get the new H1 petition approved so that they can get the visa till the validity of the newe H1 petition. This way they can stayin the US for a linger period of time without any hassles and they need not go for a visa extension until about 2 years

---- Yes, I think taht is true. The HDFC receipt has to be within the jurisdiction of the US Consulate where you seek an appointment fio the visa interviewe (I did presume that it can be otherwise). However, consult the vfs office to confirm this observation as they would be able to guide you appropriately. However, if you can take HDFC receipt at the city which falls in the jurisdiction of the US Consulate wher your folks willbe attending the vis interview then it resolves the issue

---- Hope everthing goes wll and your folks get the visa stamped on thier Passports and return to the US and join you

          Sure thing...

Thank you Subramanya. I shall keep you and rest of the guys posted once it is all done.

I was filling out DS-160 form and I have another question. First time when my wife and son came to the USA I was on L-1, so that makes their visa type L-2. This time around, I am on H-1B and obviously theirs becomes H4. Here is the question...

Was the visa last time you had different from this visa (not quite the same words)?
          A. Yes or No

If I look at just the visa type, the answer would be a YES, as it is H4 this time and L-2 last time. But if I read between the lines, as in dependent visa could be L-2 or H4, then the answer could be NO.

Please help me answer this question.

Take their passport and look into it to see what was the last stamped visa. If the last stamped visa in the passport and the one that they are applying now are the same (and if the last visa in the passport is currently valid or expired within the last 12 months), then answer "YES" to that question "Are you apply for the same type of visa which is currently valid or expired within the last 12 months". Otherwise, answer "NO".

                H4 Visa Issuance @ Hyderabad!

Hello Subramanya, Shervin & other Senior Members:

My wife and son got their visas. The passports have been received yesterday. I thank you all for your wonderful support and making this site a go-to 'place' to get help from. I hope to see a lot of others getting benefited like I did.

The interview was at Hyderabad Consulate on 01/06/11.

VO: Where does your husband work?
                My wife: Client's Name
VO: Can I see his recent pay stubs?
                MW: Handed them over
VO: The company name on your I-797 is different from the name I see on these
                pay stubs
MW: Yes, there was name change for the employer
VO: Do you have any proof that your husband works at this client? Like a
                client letter or something?
MW: Yes, here is the client letter
VO: What does he do there?
                MW: He is an XYZ
VO: OK, ma'am, you got your visas. They will reach you in a week's time.

As they said, it indeed took a week.

                Thanks again,
                -Sachin
