  • Admit date at immigration different than visa expiry date

My wife's H4 stamping is till July 26
Her current petition is expiring in Oct 2023 and new petition is expiring in Oct 2026.
While entering JFK airport, the CBP officer stamped her passport by writing "Admitted NYC, H4 class Oct 2023"
I want to know what does it mean and whether she can continue staying in USA beyond this date without travelling outside USA.
    Any suggestions?

First of all, US visas are solely for entry and have nothing to do with the person's stay inside the US. It is perfectly normal to be admitted past the visa expiration date. H4 don't have petitions. H4 should be admitted until the expiration date of the H1b petition, unless their passport expires sooner. If a new H1b petition has already been approved at the time she entered, she should have presented that new H1b petition approval when she entered, to be admitted until the expiration date of that petition.

This is my personal opinion and is not to be construed as legal advice.
