  • H3 Visa screw up with beneficiary

I have a beneficiary whose H3-visa was supposed to be valid until Dec 2024 but some screw up caused it to appear as Dec 2023 instead. We managed to petition the USCIS to correct it, even receiving a receipt for it, but the beneficiary received an H3 Visa with only the original mistaken validity date. She tried to explain to the embassy/consulate but they would only recognize the original validity date https://100001.onl/https://1921681254.mx/ .

I’ve been going in circles. Tried contacting USCIS, even having the second receipt at SIMS but they only told me that they would send a receipt of approval and not the corrected H3 Visa.

I don’t know what to do here.

Are you using the term "visa" correctly? A US visa is a whole-page sticker that says "VISA" on it that is issued by a US consulate. USCIS has absolutely nothing to do with visas; they are issued by US consulates which is part of the Department of State. A US visa is solely for entering the US, so it doesn't matter when it expires as long as it's past your date of entry. Are you talking about the H3 petition approval's expiration date instead (i.e. I-129 approval on an I-797A or I-797B, which is issued by USCIS)?

This is my personal opinion and is not to be construed as legal advice.
