Hello,
My H1B is maxing out in Feb 2024 and my PERM was filed in Apr 2023. I have 2 months gap to hit 365 days limit on PERM pending status. I am planning to travel to India now and go to stamping with the new I797 valid till Feb 2024.
1. Is it ok to go for stamping (Dropbox) with only 3 months left on I797 without having I140 approved?
2. If stamping goes fine, can I come back to US one month before H1 stamp expires? Are there any issues at the port of entry?
