  • Transferring unused H1 approval petition and Transferring L1 to H1 together

    Hello,
Please help me on this question.

I am working for company A on L1A visa. I have H1B approval petition from company B. I would like to Join company C. Can company C transfer my H1B petition from company B to C and transfer the status from L1A to H1B ?

    Thank in advance.

I am working for company A on L1A visa. I have H1B approval petition from company B.
    >>> Did Company B apply the H1B petition as a COS from your L1? Did the approval notice come with a new I-94? If YES, then you should be working for Company B now and get paid to maintain the H1B status and your employment with L1 employer is illegal post the effective date of the H1B approval notice.

I would like to Join company C. Can company C transfer my H1B petition from company B to C and transfer the status from L1A to H1B ?
    >>> The answer to this question depends on your answer to the above question. If you are still in L1 status, then it is possible. If you are in H1B status and if you are employed with the H1B employer, then it could be a problem.

yes I am still in L1A. H1 approval sponsored by company B didn't come with COS (No new I-94). Can company C transfer the H1 petition approval from company B to company C and transfer my status from L1A to H1B ?
