I have relocated to India from US 2 years ago (just before marriage). I’m planning to relocate back to US. My H1B is valid till Jan 13, 2024 (I also have an approved I 140). I got it stamped but never went back to US with the new visa. My employer has given me a new offer letter for the new role to move back.
When can I apply for my wife’s H4? Do I need to travel back to US first to be in status? Do I need to extend the H1B first before applying for H4?
