Travelling back to India due to medical emergency

I have a joined an emoloyer(consulting) 3 months back and he has applied my H1B extn as i my H1B was due for expiry in Sept 2010 and it is approved also now.

I somehow feel the salary he pays for my exprience and skillset is too less and i found a better job now in India itself. When i say the same to my employer he says i have to pay the immigration fees, 1 month notice period and other expenses to them.

Q: Its an harrasment and i can't pay so much money to my employer, can i leave to india without informing them? Would it cause any legal issues w.r.t immigration, not issuing W2, my future job prospects...etc.

Basically he is not at all taking care of me well. Also, he made lot of false promises orally but he is not doing anything in that front. So i want to leave them and work peacefully back in india.

The issue you have posted here is purely between you and your employer. It has nothing to do with U.S imigration and your immigration status will not have impact if you quit the employer and leave the country. Irrespective of how you quit the current job, the employer is suppose to give you the W2 and you have to pay your taxes. If not, then you can file a complaint and make them send the W2. It is illegal to hold the W2 by the employer.

If you have proof that your employer is asking you to pay your immigration related expenses and if he is violating any H1B regulations (Example: paying you less than the approved LCA) then you can file a complaint against the employer to DOL.
