Hi everyone,
I'm in a difficult decision making phase and like some help navigating it. Your thoughts would be greatly appreciated.
i recently got a TT asst professor job as I'm finishing my PhD at an R1. This is 7 year to tenure process, in other words, tenure review is not until 5th year, unless I opt to do it before 5th year. They've reached out to get started with the H1b visa process. This employer typically proceed with green card application within a year or less than two years of starting.
I also got married recently, a week after accepting the job offer. My partner is a citizen.
The biggest concern now is to know which green card option to pursue that'll yield the best and, perhaps, quickest result.
Pros to doing it with employer:
It's completely free, fast, with lawyer, 10-year green card.
Cons to doing it with employer:
Requires 5 years of green card to file for citizenship, 1 year or less than 2 years lost to get a second industry position while on H1b (given it's research-based role at the U, I have time to actually use my tech skills in industry). My understanding is that you can't use H1b with two different employers. Please let me know if this is not the case. Tying me to an employer for long (I don't envisage any negative experience though).
Pros to filing with partner:
Fast, 3 years to citizenship, can take another job when I want.
Cons:
Expensive, 2 year condition, another filing to take condition off, hesitation about the idea of relying on someone (in this case, my partner) to petition for me (maybe my international student independence mindset here). Not hiring a lawyer.
What are your thoughts on this? Which do you think is the best case scenario?
