  • Visa Renewal Doubt

I am trying to book my appointment with the US consulate in Chennai via VFS.

I have been in the US on work visa H1B which expired in April 2009. I have been staying in the US on a valid I-94 (which expired on May 2010). I had applied for H1B renewal in the US and got an extension until 2013.

I returned to India for visa stamping September 2010. I got rejected the visa. I now have another company file for my H1B petition, and would like to schedule an appointment for H1B interview.

How do I reply to this question on the VFS website.

"Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?"

Do I say yes, since I am applying for a renewal with another petitioner
or do I say no, since I have an expired H1b visa since 2009?

    Thanks,

Did you search for this question in immihelp. It's been answered so many times. You should answer "NO" since your old H1B visa in the passport expired more than 12 months ago.
Not a legal advice. Use of this information is strictly at your own risk.
