I've approved I140 with my current employer. I'm looking to switch job and I understand the new employer will need to start again from first step of filing PERM but I'll retain my place in the queue i.e. priority date will be ported over. My question:
1. What happens if the PERM filed with new employer is rejected? If that happens, do I need to leave the country on a short notice? (I've been burnt with PERM denial in the past due to typographical error by attorneys and that was a very painful experience as I was close to completing 6 years so I want to better understand the possible consequences before I go through the process again)
2. My current I140 was filed in EB2 category. Does it matter if the new employer files it in EB3?
